1. Introduction
1.1 Welcome to Craft Electrics. These terms and conditions govern your use of our products and services. By engaging with Craft Electrics, you agree to comply with and be bound by these terms.
2. Definitions
2.1 "Craft Electrics" refers to David Kirsfelds, a sole trader operating as Craft Electrics.
2.2 "Client" refers to the individual or entity engaging with Craft Electrics for products or services.
3. Services
3.1 Craft Electrics provides electrical services, installations, repairs, and related products to clients.
3.2 All services are subject to availability, and Craft Electrics reserves the right to refuse service at its discretion.
4. Quotations and Pricing
4.1 Quotations provided by Craft Electrics are valid for 30 days unless otherwise stated.
4.2 Prices are subject to change without notice. Any changes will be communicated to the client prior to service commencement.
5. Payment Terms
5.1 Payment terms are as agreed upon in the quotation or contract.
5.2 Invoices are due for payment within 30 days of the invoice date.
5.3 Craft Electrics reserves the right to charge interest on overdue payments at the statutory rate.
6. Cancellations and Rescheduling
6.1 Cancellations or rescheduling of appointments must be made at least 24 hours in advance. Failure to do so may result in a cancellation fee.
6.2 The client has the right to cancel a contract within 14 days without giving any reason, as per the Consumer Contracts (Information, Cancellation, and Additional Charges) Regulations 2013.
6.3 To exercise the right to cancel, the client must inform Craft Electrics of their decision to cancel by a clear statement sent to info@craftelectrics.co.uk.
6.4 If the client cancels the contract, Craft Electrics will reimburse all payments received, including the cost of standard delivery, without undue delay and in any event not later than 14 days from the day on which Craft Electrics is informed about the client's decision to cancel.
6.5 Craft Electrics may make a deduction from the reimbursement for loss in value of any goods supplied if the loss is the result of unnecessary handling by the client.
6.6 If the client requests that a service starts straightaway, the right to cancel still applies. However, the client must pay for the value of the service that is provided up to the point of cancellation.
6.7 If the service is provided in full within the 14-day cancellation period, the right to cancel can be lost if the service is completed before the 14 days elapse.
7. Property Damage
7.1 Craft Electrics will take all reasonable precautions to minimise any potential damage to the client's property during the provision of services.
7.2 In the event that Craft Electrics determines, in its professional judgment, that necessary damage to the client's property is unavoidable to complete the electrical job safely and effectively, Craft Electrics will make reasonable efforts to inform the client in advance.
7.3 The client acknowledges that certain electrical work may require drilling, cutting, or other actions that could result in damage to walls, ceilings, or other structures. Craft Electrics will exercise due care and skill in performing such tasks.
7.4 Craft Electrics shall not be held liable for any damage to the client's property that is a direct result of the necessary actions taken to complete the electrical job, provided such actions are in accordance with industry standards and regulations.
7.5 Craft Electrics agrees to promptly rectify and repair any damage directly caused by its negligence during the provision of services, as long as such damage is reported to Craft Electrics within 14 days of completion of the job.
8. Work Site
8.1 Craft Electrics technicians will make use of client facilities as necessary while on site. This may include access to power sources, restrooms, and other reasonable facilities.
8.2 Craft Electrics technicians will store tools and equipment neatly at the end of each workday to maintain a safe and organised work environment.
8.3 Craft Electrics technicians will make reasonable efforts to leave the work site clean and tidy on completion of the works, disposing of any waste materials in accordance with relevant regulations.
9. Customer Responsibilities
9.1 The client is responsible for taking note of all safety warnings provided by Craft Electrics and for following all reasonable instructions given by Craft Electrics in regards to the works being carried out.
9.2 The client shall not allow any unauthorised persons, including children, to access the site during work times.
9.3 The client agrees to give Craft Electrics access to the site during the agreed working hours throughout the working period.
9.4 The client agrees to keep the site clear of obstructions to allow Craft Electrics to carry out the works efficiently.
10. Limitation of Liability
10.1 Craft Electrics shall not be liable for any indirect, consequential, special, incidental, or punitive damages, including but not limited to loss of profits, loss of business, loss of data, or other intangible losses, arising out of or in connection with the services provided, whether in contract, tort (including negligence), or otherwise.
10.2 To the fullest extent permitted by law, Craft Electrics' total liability to the client for any claim arising out of or in connection with the services, regardless of the cause of action, shall not exceed the total amount paid by the client to Craft Electrics for the specific services giving rise to the claim.
10.3 Craft Electrics shall not be liable for any damages or losses incurred as a result of:
Acts or omissions of the client, including but not limited to failure to follow instructions, providing inaccurate information, or failure to comply with safety recommendations.
Acts or omissions of third parties, including subcontractors, suppliers, or other service providers.
Force majeure events or circumstances beyond Craft Electrics' reasonable control, including but not limited to natural disasters, strikes, acts of war, or government actions.
10.4 The client acknowledges and agrees that the limitations of liability set forth in this clause are reasonable and essential elements of these terms and conditions and that they form the basis of the bargain between the parties.
11. Updates to Terms and Conditions
11.1 Craft Electrics reserves the right to update these terms and conditions from time to time. The most current version will be posted on the Craft Electrics website.
11.2 Clients will be notified of any significant changes to the terms and conditions. Continued use of Craft Electrics' products and services after such notification constitutes acceptance of the updated terms and conditions.
12. Liability and Warranty
12.1 Craft Electrics is not liable for any loss or damage arising from the use of its products or services unless directly caused by Craft Electrics' negligence.
12.2 Craft Electrics provides a warranty on its workmanship for a period of 5 years from the completion date.
13. Health and Safety
13.1 Craft Electrics complies with all relevant health and safety regulations. Clients are expected to provide a safe working environment for our technicians.
14. Intellectual Property
14.1 All intellectual property rights related to Craft Electrics' products and services remain the property of David Kirsfelds.
15. Governing Law
15.1 These terms and conditions are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
